Application for prior declaration
Procedures for minor projects that do not require full planning permission.
Prior declaration is an essential administrative step for many extension or alteration projects. ERHÉ Architecture knows how to navigate this process, ensuring that your projects meet all legal requirements.
The importance of a prior declaration
Prior planning permission is required to ensure that your small-scale projects comply with local planning regulations. It is a key stage in projects such as alterations to façades, small extensions or changes of use to a building.
Our role in your preliminary declaration
Initial analysis of the project : we start with a detailed assessment to determine whether your project requires a prior declaration.
Preparing and submitting the file : we gather all the necessary documents, such as site plans, façade drawings and project details, and take care of submitting the file.
Follow-up and advice : we will follow up the application with the local authorities and advise you on any requests for amendments or additional information.
Timescales for this phase (given as an indication and to be adjusted according to the project) :
Small-scale project (e.g. house) : 3 to 4 weeks
Large-scale works : 4 to 8 weeks
Time taken to process a preliminary planning application at the town hall
It takes 1 month from the date the application is submitted to the Mairie.
The Mairie will issue you with a receipt. This contains the registration number of your application and information about the date from which work may begin.
This receipt specifies that, within 1 month of submitting the application, the Mairie may notify you of a different deadline for starting the work. It also has 1 month to inform you if your application is incomplete.
Period of validity of a prior planning declaration :
Your DP is valid for 3 years.
It lapses if you do not start work within 3 years or if, after this period, you interrupt the work for more than 1 year.
Where the PD relates to a change of use or a division of land, the decision will lapse if these operations have not taken place within 3 years.
The period of validity may be extended twice for a period of 1 year if the planning regulations and administrative easements have not changed.
You must submit your request at least 2 months before the end of the initial period of validity of your planning permission (or before the end of the period of validity of your 1st extension request).
This request must be made on plain paper, in duplicate, by registered letter (RAR: Recommandé avec avis de Réception).
On receipt of your request, the Mairie has 2 months to reply.
An extension is granted if you do not receive a reply within this time.
Only valid planning permission can be extended.
